Abstract

The Court of Justice of the European Union has made public two opinions of its Advocates general in cases related to discrimination on the grounds of religion or belief in employment, both concerning the use of personal religious symbols. This article analyzes these two opinions, which stem from conflicting views and reach different conclusions. At the outset, some notions on equality and non-discrimination in the European Union are presented. The article concludes that the outcome of the future decisions of the Court of Justice of the European Union is uncertain. However, the analyzed opinions already have a remarkable value on their own, since they contribute significant arguments to the legal debate on the fundamental right of religious freedom and on non-discrimination on the grounds of religion or belief.
